1. Introduction

These Terms and Conditions ("Terms") govern your use of the Omo Tales website and the purchase of our personalised children's storybooks.

By using our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our service.

Omo Tales is operated by Scionslabs Limited ("we", "us", or "our"), a company registered in England and Wales. Registered office: [Address to be confirmed].

These Terms comply with the UK Consumer Rights Act 2015 and other applicable UK consumer protection laws.

2. Definitions

  • "Service" refers to the Omo Tales website and all associated services
  • "Product" refers to the personalised storybooks we create and deliver (digital and/or physical)
  • "You" or "Customer" refers to the person placing the order
  • "Order" refers to your purchase of a personalised storybook

3. Service Description

Omo Tales provides a service to create personalised children's storybooks using artificial intelligence (AI). Our service includes:

  • An online character creation tool where you customise the main character
  • AI-generated illustrations featuring your personalised character
  • A preview system allowing you to see sample illustrations before purchase
  • Digital PDF delivery of your completed book (for all product tiers)
  • Printed and bound physical books (for Softcover, Hardcover, and Ultimate tiers)

All illustrations are generated uniquely for your order using Google's Gemini AI. No two books are identical.

4. Ordering Process

4.1 Character Creation

You will create a character by providing details such as name, age, physical features, and cultural heritage. You may optionally upload a reference photo.

4.2 Preview and Approval

Before payment, we will generate 3 preview images (portrait, cover, and one scene from the story). You will have 3 free attempts to regenerate these previews if you're not satisfied, plus 1 additional attempt with feedback.

By clicking "Approve" on the preview, you confirm that the character representation meets your expectations. Once approved, the character identity is locked for your order.

4.3 Payment

Payment is processed securely through Stripe. By completing payment, you agree to purchase the book based on the approved preview.

4.4 Order Confirmation

Once payment is successful, we will send an order confirmation email. A contract is formed between you and us at this point.

5. Pricing and Payment

5.1 Product Tiers

We offer four product tiers:

  • Digital Only (£14.99): Digital PDF only, no physical book
  • Softcover (£24.99): Digital PDF + softcover perfect-bound physical book
  • Hardcover (£34.99): Digital PDF + hardcover case-bound physical book
  • Ultimate (£54.99): Digital PDF + premium hardcover + gift wrapping + video/audio add-ons

Prices include VAT where applicable.

5.2 Shipping Costs

Shipping costs for physical books are calculated at checkout based on your delivery address. UK standard shipping is typically £3.99.

5.3 Payment Methods

We accept all major credit and debit cards via Stripe. Payment is taken in full at the time of order.

6. Production and Delivery

6.1 Production Time

After payment, your book will be generated by our AI system. This typically takes:

  • Digital PDF: Usually ready within 24 hours (often within 1-2 hours)
  • Physical books: Printed and dispatched within 3-5 working days after digital PDF is ready

Please note that production times are estimates and may be longer during peak periods.

6.2 Digital Delivery

Once your digital PDF is ready, we will send you an email with a download link. The link will remain active for 30 days. You can also access it from your order status page.

6.3 Physical Book Delivery

Physical books are printed by our UK-based partner, BookVault, and shipped via Royal Mail or courier. Estimated delivery times:

  • UK: 2-4 working days after dispatch
  • International: 7-14 working days after dispatch

You will receive a shipping confirmation email with tracking information when your book is dispatched.

7. Quality Review Process

All AI-generated books undergo a quality review before final delivery. Our team checks:

  • Character consistency across all pages
  • Illustration quality and appropriateness
  • Text rendering and layout

If an illustration does not meet our quality standards, we will regenerate it before sending you the final PDF. This is included in your order at no extra cost.

8. Your Obligations

When using our service, you agree to:

  • Provide accurate information (name, email, shipping address)
  • Only upload photos you have the right to use (e.g., your own child)
  • Not upload photos containing nudity, violence, or offensive content
  • Not use our service for unlawful purposes or to create offensive content
  • Not attempt to reverse-engineer or misuse our AI generation system
  • Respect our intellectual property rights (see Section 10)

We reserve the right to refuse service or cancel orders that violate these obligations.

9. Cancellation and Refunds (UK Consumer Rights Act 2015)

9.1 Your Right to Cancel (Digital Products)

Under the UK Consumer Contracts Regulations 2013, you have the right to cancel an online order within 14 days of purchase. However, this right does NOT apply to personalised digital content once delivery has begun with your consent.

By approving the preview and paying, you explicitly consent to us beginning production of your personalised book immediately. Once generation starts, the 14-day cancellation right no longer applies to the digital product.

9.2 Cancellation Before Production

You may cancel your order within 1 hour of payment if production has not yet started. Contact us immediately at hello@omotales.com. We will issue a full refund.

9.3 Physical Books (UK Consumer Rights Act 2015)

For physical books, you have the right to return the book within 14 days of receiving it if:

  • The book arrives damaged or defective
  • The book does not match the preview or description
  • There was an error in production (wrong name, missing pages, etc.)

Note: Because each book is personalised and made to order, we cannot accept returns based on a change of mind unless the book is faulty or not as described.

9.4 Refund Process

Approved refunds will be processed within 14 days to your original payment method. For physical book returns, you must return the book to us in its original condition (we will provide a return address).

9.5 Quality Guarantee

If you are not satisfied with the quality of your book (e.g., character does not match preview, printing defects), contact us within 30 days of receiving it. We will:

  • Offer a free reprint if the issue is on our end (e.g., printing error, character mismatch)
  • Provide a full refund if we cannot resolve the issue

10. Intellectual Property Rights

10.1 Your Book

Once you purchase a book, you receive a personal, non-exclusive, non-transferable licence to:

  • Print the digital PDF for personal use
  • Share photos of the physical book on social media for personal purposes
  • Read the book to your child

You may NOT:

  • Resell, redistribute, or commercially exploit the book or illustrations
  • Use the illustrations in other products, merchandise, or marketing
  • Claim ownership of the underlying story template or AI-generated artwork
  • Reverse-engineer or extract individual illustrations for other purposes

10.2 Our Content

All content on the Omo Tales website, including story templates, text, design, and branding, is owned by Scionslabs Limited or licensed to us. You may not copy, reproduce, or use this content without permission.

10.3 AI-Generated Content

The illustrations in your book are generated by AI (Google Gemini). While the AI creates unique images for each order, we retain all rights to the underlying generation process and story templates.

11. Limitation of Liability

11.1 What We Are Responsible For

Nothing in these Terms limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded under UK law

11.2 AI-Generated Content Disclaimer

Our books are generated using artificial intelligence. While we make every effort to ensure quality, AI-generated content may occasionally:

  • Vary slightly from the preview
  • Contain minor inconsistencies in character appearance across pages
  • Require regeneration if quality does not meet our standards

We review all books before delivery and will regenerate any pages that do not meet acceptable quality standards at no cost to you.

11.3 Service Availability

We aim to provide a reliable service but cannot guarantee uninterrupted access. We are not liable for:

  • Service downtime due to maintenance or technical issues
  • Delays caused by third-party services (Stripe, AI provider, print partner)
  • Loss of data due to circumstances beyond our reasonable control

11.4 Maximum Liability

Subject to Section 11.1, our total liability for any claim arising from your order is limited to the amount you paid for that order.

12. Data Protection and Privacy

We take your privacy seriously. Our use of your personal data is governed by our Privacy Policy, which forms part of these Terms.

Key points:

  • Uploaded photos are deleted 30 days after order completion
  • We comply with UK GDPR and Data Protection Act 2018
  • You have rights to access, correct, or delete your data

13. Third-Party Services

Our service relies on third-party providers (Stripe for payments, Google Gemini for AI, BookVault for printing, Resend for email). While we partner with reputable providers, we are not responsible for their services or any issues arising from them (e.g., payment processing errors, AI service downtime, printing delays).

Your use of these third-party services is subject to their own terms and privacy policies.

14. Dispute Resolution

14.1 Contact Us First

If you have a complaint or dispute, please contact us first at hello@omotales.com. We will do our best to resolve the issue informally.

14.2 Alternative Dispute Resolution

If we cannot resolve your complaint, you may use the EU Online Dispute Resolution platform (even though we are UK-based, this is still accessible for consumer disputes): https://ec.europa.eu/consumers/odr

14.3 Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

15. Changes to These Terms

We may update these Terms from time to time. Significant changes will be notified via email (if you've provided one) or a notice on our website.

Changes do not affect orders already placed. Your order is governed by the Terms in effect at the time of purchase.

17. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the use of our service.

If any part of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
